Travel Reservation Form

This Travel Reservation Form (TRF) is a binding agreement between MT Progress LLC (Hereinafter called Tour Operator) and any individual(s) herein referred to as “Traveler”, intending to travel with MT Progress LLC or designated Tour Operator. This Reservation Form constitutes an official Traveler registration for travel, and acceptance is likewise of the Tour Operator’s General Terms & Conditions. All information collected will be used or disclosed only for the purposes of planning your travel by MT Progress LLC and its designated Tour Operators and Airlines.

Please print, sign and date this TRF. Please make additional copies of this TRF if there are more than 2 persons traveling. A parental signature is required for any traveler under the age of 18 years.

Please read the following information to ensure that you fully understand all booking terms and conditions, how payments are made, our cancellation policy and our insurance waiver

1. HOW TO BOOK

1. Fill out the reservation forms and send them to MT Progress LLC. (“Mongol Tours” or the “Tour Operator”) together with a non-refundable deposit amount mentioned clause 3 in the agreement. On receipt of your signed reservation form and deposit, we will, subject to availability, reserve your place on your selected in this tour itinerary. Once you receive your confirmation invoice, your reservation is confirmed and accepted by us.
2. b) Final payment is due to MT Progress LLC not later than 31 days prior to departure. On receipt of your full payment, we will send vouchers, in detailed tour information, clothing lists, etc. Please ensure that you receive the information before you leave for Mongolia.

2. PASSPORT & VISAS

The onus is upon the guest to ensure that passports and visas are valid for the Mongolia. MT Progress LLC can supply an official confirmation letter (by email or post) for your visa application once you book a travel service with us. However Tour Operator cannot be held liable for any visas, etc. not held by the guests, nor the cost of visas.

3. DEPOSITS

At the time of booking, a non-refundable deposit of USD$500, GBP£385, EUR€425, as applicable, per person per Tour is due to the Tour Operator. If the booking is made 30 days or less prior to departure, full payment is due at the time of booking. The non-refundable deposit should be sent to the Tour Operator or authorized agent, as applicable.

4. METHODS OF PAYMENT

We accept Wire transfers and PayPall.com 

Please be informed that you should pay the bank charge of 20 ~25 USD of each transfer.

The Tour Operator is not responsible for any charges levied by third parties or financial institutions and payable by you as a result of credit card or other payment transactions and will not refund or return any fees charged by third parties or financial institutions in connection with payments made by you to the Tour Operator.

5. IF YOU CHANGE YOUR BOOKING

After your booking has been confirmed, should you wish to make any changes to your itinerary or wish an earlier departure date, we will make every effort to accommodate your requests based on availability. However, there may extra costs involved to accommodate your request. These costs are in addition to the fee quoted for your initial trip cost. Normal cancellation fees apply if you wish to postpone your departure.

6. CANCELLATION

You may cancel your booking by notifying the Tour Operator. Cancellation fees, if any, will be determined with reference to the date on which notice of cancellation is received by the Tour Operator and are expressed as a percentage of the total price paid for the canceled Tour, product or service (excluding any insurance products).

Cancellation of a Tour:
(a) Cancellation received 30 days or more before departure of first product or service in relevant booking: Deposit will be held by the Tour Operator in accordance with these Terms, the total payments made to the Tour Operator in respect of the canceled product will be refunded.
(b) Cancellation received 29-15 days before departure of first product or service in relevant booking: Deposit will be held by the Tour Operator in accordance with these Terms, an amount equal to 50% of the remainder of the payments made to the Tour Operator in respect of the canceled Tour will be refunded.
(c) Cancellation less than 14 days before departure of first product or service in relevant booking: Deposit will be held by the Tour Operator in accordance with these Terms, and no further refund will be payable.

For certain products of services the Tour Operator, including bookings on or related to the certain trip, alternative cancellation terms may apply. The Tour Operator will advise you of any such requirements prior to confirmation of the applicable booking.

Cancellation of Arrival Transfers, Pre and Post Night Accommodations, My Own Room and optional activities booked directly with the Tour Operator:
(a) Cancellation 15 days or more before departure: you will receive a full refund in respect of canceled Arrival Transfers, Pre and Post Night Accommodations, and optional activities.
(b) Cancellation 14 days or less before departure: No refund will be payable in respect of any canceled Arrival Transfers, Pre and Post Night Accommodations, and optional activities.

7. SPECIAL REQUIREMENTS

Any special requirements must be disclosed to the Tour Operator at the time of booking. The Tour Operator will use reasonable efforts to accommodate special requirements or requests but this is not always possible given the nature of the destinations visited and availability of options outside a planned itinerary. Certain activities may be inaccessible to you if your mobility is limited in any way. All food allergies and dietary restrictions must be disclosed to the Tour Operator at the time of booking but the Tour Operator cannot guarantee that dietary needs or restrictions can be accommodated. Any special requests or requirements do not form part of these Terms or the contract between you and the Tour Operator and the Tour Operator is not liable for any failure to accommodate or fulfill such requests.

8. CHANGES TO SCHEDULES

Although every effort is made to adhere to schedules it should be borne in mind that the Tour Operator reserves the right and in fact is obliged to occasionally change routes and camps in the countryside as dictated by changing conditions. Such conditions may be brought about by seasonal rainfall, airfields and in game areas, by game migrations from one region to another, or airline or other booking problems, etc.

9. INSURANCE

It is a condition of booking, that the sole responsibility lies with the guest to ensure that they carry the correct comprehensive travel and medical insurance to cover themselves, as well as any dependants/traveling companions for the duration of their trip in Mongolia. This insurance should include cover in respect of, but not limited to, the following eventualities: cancellation or curtailment of the trip in Mongolia, emergency evacuation expenses, medical expenses, and repatriation expenses, damage/theft/loss of personal baggage, money and goods. MT Progress LLC, including their representatives, employees, and agents will take no responsibility for any costs, losses incurred or suffered by the guest, or guest’s dependants or traveling companions, with regards to, but not limited to, any of the above-mentioned eventualities. Guests will be charged directly by the relevant service providers for any emergency services they may require and may find themselves in a position unable to access such services should they not be carrying the relevant insurance cover.

10. NOT INCLUDED

You are strongly recommended to extend your coverage to include cancellation and curtailment, and all other expenses that may arise as a result of loss, damage, injury, delay or inconvenience while traveling. Moreover beverages in certain areas; personal laundry at certain camps; gratuities to guides, paddlers and to staff; any excursion not related to the trip in the countryside; if any additional meals, scheduled airfares; transfers and departure taxes are not included in the price.

11. LUGGAGE

For safety and because space is restricted, luggage in some vehicle is restricted to a maximum of 30 kg per person. This includes camera equipment and carry-on baggage. Should guests arrive with excess luggage without prior warning their luggage could be rejected to load due to vehicle capacity is exceeded.

 

12. HEALTH

Mongolia’s dry, cold climate and sparse human habitation means there are few of the infectious diseases that plague tropical countries in Asia. Injuries sustained from falling off a horse are common in the summer season. In winter, the biggest threats are the flu and pneumonia, which spread like wildfire in November. Any disease precautions should be commenced prior to departure. Please consult our doctor for specific advice. If you are a contagious-disease carrier, you must let us know when booking your tour in Mongolia.  

Pregnancy is considered a medical condition and must be disclosed to the Tour Operator at the time of booking. The Tour Operator may refuse to carry pregnant women over 24 weeks. The Tour Operator may refuse to carry anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged.

13. RESPONSIBILITY

Neither MT Progress LLC nor any person or agent acting for, through or on behalf of the Tour Operator shall be liable for any loss or damage whatsoever arising from any cause whatsoever and without restricting the generality of the aforegoing shall particularly not be responsible for loss or damage arising from any errors or omissions contained in its brochure or other literature, loss or damage caused by delays, sickness, theft, injury or death. In addition the Tour Operator shall have the right at any time at its discretion to cancel this particular tour in Mongolia or the remainder thereof or make any alteration in route, accommodation, price or other details and, in the event of any tour the Mongolia being rendered impossible, illegal or inadvisable by weather, strike, war, government or interference or any other cause whatsoever, the extra expenses incurred as a result thereof shall be the responsibility of the traveler. The Tour Operator may at its discretion and without liability or cost to itself at any time cancel or terminate the guest’s booking and in particular without limiting the generality of the aforegoing it shall be entitled to do so in the event of the illness or the illegal or incompatible behavior of the guest, who shall in such circumstances not be entitled to any refund. The person making any booking will, by the making of such booking, warrant that he or she has authority to enter into a contract on behalf of the other person included in such a booking and in the event of the failure of any or all of the other persons so included to make payment, the person making the booking shall by his/her signature thereof assume personal liability for the total price of all bookings made by him/her.

14. FLEXIBILITY & UNUSED SERVICES

You acknowledge that the nature of adventure travel requires flexibility and acknowledges that they will permit reasonable alterations to products, services or itineraries by the Tour Operator. The route, schedules, accommodations, activities, amenities and mode of transportation are subject to change without notice due to unforeseeable circumstances or events outside the control of the Tour Operator (including but not limited to Force Majeure, illness, mechanical breakdown, flight cancellations, strikes, political events and entry or border difficulties). No reimbursements, discounts or refunds will be issued for services that are missed or unused after departure due to no fault of the Tour Operator, including your removal from a Tour because of your negligence or breach of these Terms.

15. AIRFARE

Tour prices do not include international or other airfare unless expressly mentioned in the Tour’s descriptions. The Tour Operator can book scheduled airline flights to, from and within Mongolia via a flight consolidator. However, please note the Tour Operator will quote the best price available for the travel dates requested at the time the quote is prepared. Quotes provide an estimate only and are not a firm price commitment by the Tour Operator or the applicable air carrier(s).

The Tour Operator acts only as a sales agent for the applicable air carrier and the air carrier terms and conditions apply to the purchase and use of the air travel ticket. Please consult the air carrier’s applicable terms and conditions and conditions of carriage for complete information including applicable cancellation terms. The Tour Operator is not responsible for changes in air itineraries or flight times and does not provide advice or alerts regarding air travel tickets, flight status or delays.

16. ACCEPTANCE OF RISK

You acknowledge that adventures travel and the products and services offered by the Tour Operator may involve a significant amount of risk to your health and safety. By traveling with the Tour Operator you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risk and releases the Tour Operator from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in Tour itineraries or otherwise offered by the Tour Operator.

You acknowledge that the degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates, and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, participation in “extreme sports” or other high-risk activities, or with developing infrastructure in Mongolia. Standards of hygiene, accommodation and transport in certain areas where tours take place are may lower than the standards you may reasonably expect in your home country or region. You acknowledge you have considered the potential risks, dangers and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.

You agree to take all prudent measures in relation to your own safety while on Tour including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. Neither the Tour Operator nor its Third Party Suppliers (as defined herein) are liable for loss or damages caused by your failure to comply with safety instructions or warnings.

You must at all times strictly comply with all applicable laws and regulations of the country and region. Should you fail to comply with the above or commit any illegal act when on Tour or, if in the opinion of the Tour Operator (acting reasonably), your behavior is causing or is likely to cause danger, distress or material annoyance to others, the Tour Operator may terminate your travel arrangements on any product or service immediately at your expense and without any liability on the Tour Operator’s part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.

You are responsible for any costs (including repair, replacement and cleaning fees) incurred by the Tour Operator or the Tour Operator’s suppliers for property damage, destruction or theft caused by you while on a Tour. You agree to immediately report any pre-existing damage to a representative of the Tour Operator and staff of the accommodation, transportation service, or facility as soon as possible upon discovery.

You agree to bring any complaints to the Tour Operator as soon as possible in order to provide the Tour Operator with the opportunity to properly address such complaint. You agree to inform your tour leader, another representative of the Tour Operator or the Tour Operator’s customer service department directly. The Tour Operator assumes no liability for complaints that are not properly brought to the attention of the Tour Operator and cannot resolve or attempt to resolve complaints until proper notice is provided. Any complaint made after the completion of a Tour must be received in writing by the Tour Operator within 30 days of the last day of travel of the booking in question.

17. If one of our guides is unable to take a tour due to illness, etc. we reserve the right to substitute with another guide.
18. THE TOUR OPERATOR IS NOT LIABLE FOR THIRD PARTY SUPPLIERS

The Tour Operator makes arrangements with accommodation providers, activity providers, airlines, coach companies, transfer operators, tour and local guides, and other independent parties (“Third Party Suppliers”) to provide you with some or all of the components of your booking. Third Party Suppliers may also engage the services of sub-contractors. Although the Tour Operator takes all reasonable care in selecting Third Party Suppliers, the Tour Operator is unable to control Third Party Suppliers, does not supervise Third Party Suppliers and therefore cannot be responsible for their acts or omissions. Any services provided by Third Party Suppliers are subject to the terms and conditions imposed by these Third Party Suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and agreements that govern the provision of their services. These may limit or exclude liability of the Third Party Supplier. You acknowledge that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and the Tour Operator does not warrant that any Third Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.

19. IMAGES AND MARKETING

You agree that, while participating in any Tour, images, photos or videos may be taken by other participants, the Tour Operator or its representatives that may contain or feature you. You consent to any such pictures being taken and grants a perpetual, royalty-free, worldwide, irrevocable license to the Tour Operator, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.

20. PRIVACY POLICY

The Tour Operator must collect your personal information to deliver the Tour and any products or services booked. The Tour Operator collects, uses and discloses only that information reasonably required to enable the Tour Operator and its Third Party Suppliers to provide the particular service and products that you have requested. By submitting any personal information to the Tour Operator, you indicate your acceptance of the Tour Operator’s Privacy Policy

21. CONSENT

The payment of the deposit OR any other partial payment for a constitutes consent by all guests covered by that payment to all provisions of the conditions and general information contained in this document whether the guest has signed the reservation form or not. The terms, under which you agree to take this tour in Mongolia, cannot be changed or amended except in writing signed by an authorized director of the Tour Operator.

22. APPLICABLE LAW

This agreement is made subject to and shall be governed by and construed according to the laws of the Mongolia in which the tour takes place. The Tour Operator only makes your travel arrangements and acts merely as an agent for the operating companies.
